DEFINITIONS

ORIENTANA.PL ONLINE STORE REGULATIONS
The terms used in the Regulations mean:

Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, which places an Order within the Store;

Regulations – these Regulations for the provision of electronic services for the online store at orientana.pl;

Internet Service – the Internet service available at orientana.pl, which includes the Online Store, through which the Customer may, in particular, place Orders;

Seller – Orientana sp. z o. o.

Goods – products presented in the Online Store which is part of the orientana.pl Website;

Sales Agreement – ​​a sales agreement for Goods concluded between the Seller and the Customer, concluded using the online service of the Store;

Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827);

Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);

Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

I. GENERAL PROVISIONS

1.1. These Regulations define the rules of using the online store available at orientana.pl;

1.2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.

1.3. The online store operating at www.orientana.pl is run by the Seller.

The Store's correspondence address is:

1.4. These Regulations specify in particular:

a) rules for registration and use of the account in the online store;

b) terms and conditions for making electronic reservations for products available in the online store;

c) terms and conditions for submitting Orders electronically via the online store;

d) principles of concluding Sales Agreements using the services provided within the Online Store.

1.5. Customers can access these Regulations at any time via the link provided on the website www.orientana.pl. Access to the Regulations is free of charge.

II. RULES OF USING THE ONLINE STORE

2.1. To use the Online Store, the Customer must have an electronic device, i.e. a computer, tablet, smartphone that allows the use of Internet resources.

2.2. In order to conclude a Sales Agreement via the Online Store, go to the website www.orientana.pl, select products, and perform subsequent technical actions based on the messages displayed to the Customer and the information available on the website.

2.3. The Customer selects the Goods to be ordered by adding them to the shopping cart.

2.4. During the Order placement process – until the “Buy and pay” button is pressed – the Customer has the option to modify the entered data and the selection of the Goods. For this purpose, the Customer should follow the messages displayed to them and the information available on the website.

2.5. Registration on the website is not necessary to place an order in the Online Store.

2.6. After the Customer using the Online Store has provided all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information regarding:

a) the subject of the order,

b) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

c) selected payment method,

d) selected delivery method,

2.7. In order to send an Order, it is necessary to accept the Regulations, provide personal data marked as mandatory and click the "Buy and pay" button.

2.8. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Store Operator, in accordance with the Regulations.

2.9. After placing the Order, the Customer receives an e-mail entitled "Order Confirmation", which confirms the placement of the Order.

2.10. The Agreement is deemed to have been concluded upon receipt by the Customer of the e-mail message referred to above.

2.11. The sales agreement is concluded in Polish, with content consistent with the Regulations.

2.12. The Online Store reserves the right to cancel the order if the customer does not pay for the goods within 7 business days.

III. USER REGISTRATION

3.1 The Customer may register on the website by creating a user account – to do this, register an account on the website www.orientana.pl and accept the provisions of these Regulations.

3.2 Correct registration involves completing all required fields of the registration form.

3.4 The processing of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) is regulated by the Privacy Policy located at: www.orientana.pl /polityka-prywatnosci.

3.5 Providing personal data during registration or placing an order is voluntary, although necessary for the performance of the Sales Agreement concluded by the Customer of the orientana.pl online store with the Seller. The Customer has the right to access the content of their data and correct it, which can also be done in the user panel.

3.6 The customer may delete the user account and terminate the service provision agreement for the operation of the orientana.pl online store at any time and free of charge.

3.7 Any complaints regarding services provided electronically and related to the operation of the orientana.pl online store may be submitted by the Customer to the following e-mail address: sklep@orientana.pl. A complaint submitted in this way will be considered by the Seller within 14 days from the date of its receipt by the Seller.

3.8 Registration is free of charge.

3.9. The Customer is obliged to immediately update the personal data provided during Registration.

IV. DELIVERY

4.1. Delivery of Goods takes place to the address indicated by the Customer when placing the Order. The Seller's obligation is to deliver Goods without defects. The Seller is responsible for the compliance of the performance with the contract.

4.2. We make every effort to ensure that the order is processed and shipped as quickly as possible. The order shipping time is from 1 to 3 business days from the day the Customer pays for the Order. We ship almost all orders within 24 hours of placing them, only in exceptional cases may their execution be extended.

4.3. Delivery of ordered Goods is made by courier, post or using the Inpost parcel locker service or by personal collection, depending on the Customer's choice. Delivery costs are precisely specified when placing the order and visible under the list of selected products. The total payment of the Customer is the sum of the price of all ordered products and the cost of delivery.

4.4 The duration of delivery after the shipment is picked up by the carrier depends on the type of delivery method chosen by the customer and is determined by the regulations of the individual carriers.

a) the delivery time in the case of choosing the services of Poczta Polska is approximately 3-5 working days within Poland, and for a foreign shipment it depends on the selected destination country.

4.5. The recording, securing, making available and confirmation to the Customer of the essential provisions of the Goods Sale Agreement shall be made by sending to the Customer an e-mail address provided and by attaching a printout of the confirmation or specification of the Order or a receipt or VAT invoice to the shipment containing the Goods.

V. PRICES AND PAYMENT METHODS

5.1. Prices of Goods are given in Polish zloty and include all components, including VAT (with the rate indicated).

5.2. The customer has the option to pay the price:

b) payment via PayU.

c) PayPal payment,

d) payment by card (Visa and Mastercard).

VI. WITHDRAWAL FROM THE SALES AGREEMENT

6.1 The Customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.

6.2 In order to exercise the right to withdraw from the contract, the Customer must inform the Store of his/her decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by e-mail to the following address: sklep@orientana.pl; or by traditional mail to the address: Orientana, ul. Lirowa 48, 02-387 Warsaw). The Customer has the right to use the model withdrawal form, however, using this model is not obligatory. The model withdrawal form is available on the Website.

6.3 In order to meet the deadline for withdrawal from the contract, it is sufficient to send the information concerning the exercise of the Customer's right to withdraw from the contract before the deadline for withdrawal expires.

6.4 The Buyer (Consumer and Entrepreneur with Consumer Rights) has the right to withdraw from the concluded contract in writing without giving any reason within 14 (in words: fourteen) days from the date of conclusion of the contract pursuant to the Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended). In the event of a written withdrawal from the contract, the Customer is obliged to return the goods within 14 (in words: fourteen) days from the date of conclusion of the contract.

6.5 In the event of exercising the right to 14 days of withdrawal, the cost of returning the goods shall be borne by the buyer.

6.6 Consequences of withdrawal from the contract:

a) In the event of withdrawal from this agreement, we will return to the Customer all payments received from him, including the costs of delivering the goods, immediately and in any case no later than 14 days from the day on which the Store was informed of the Customer's decision to exercise the right to withdraw from the agreement. The payment will be returned using the same method that the Consumer used, unless the Consumer has expressly agreed to another method of return that does not involve any costs for him. The Store may withhold the return of the payment until the goods are received or until proof of their return is provided, depending on which event occurs first.

b) The Customer is obliged to return the Goods to the Seller immediately, but no later than within 14 days from the date on which he withdrew from the Sales Agreement. To meet the deadline, it is sufficient to return the Goods to the Seller's address before the expiry of this deadline.

c) The right to withdraw from the Sales Agreement does not apply to the Customer who is a Consumer in relation to agreements in which the Goods are items delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.

d) If the Consumer exercising the right of withdrawal has chosen a method of delivery of the Goods other than the cheapest standard method of Delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred by him.

e) In the event of withdrawal, the Customer who is a Consumer shall bear only the direct costs of returning the Goods.

f) The Consumer is liable for any reduction in the value of the Goods resulting from their use in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

g) The address to which the Customer returns the goods is:

VII. COMPLAINTS REGARDING GOODS

7.1. The law provides for the seller's liability for the compliance of the performance with the contract. The seller is liable to the customer within the meaning of art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the provisions of law, in particular in the Civil Code and the Consumer Rights Act.

7.2. Complaints should be sent by e-mail to the following address: sklep@orientana.pl, or by traditional mail to the following address: Orientana, ul. Lirowa 48, 02-387 Warsaw. Orientana undertakes to consider each complaint within 14 days.

7.3. In case of necessity to return the product, the Customer should send the item to the Store's address: Orientana, ul. Lirowa 48, 02-387 Warsaw. The shipping cost will be refunded to the customer if the complaint is accepted.

7.4. If the complaint results in the return of goods, the Store shall refund the customer the full amount paid for the goods and the cost of delivery.

7.5. The Seller is not the manufacturer of the Goods.

7.6 Orientana shall be liable to the Consumer and the Entrepreneur under the rights of the Consumer for any lack of conformity of the Goods with the sales contract existing at the time of their delivery and revealed within two years from the date of issue or expiry of the minimum durability of the Goods.
7.7 Orientana is liable to the Consumer and the Entrepreneur with the rights of the Consumer in this respect under the principles specified in the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2022, item 2337).
A complaint may be submitted by a Consumer or an Entrepreneur with Consumer rights in writing/by e-mail and sent to the following address: sklep@orientana.pl

7.8 An entrepreneur making purchases for business-related purposes, but not for professional purposes, has the right to withdraw from the contract within 14 days.

7.9 An entrepreneur making purchases for purposes related to their business activity, but not of a professional nature for the buyer, has the right to make a complaint. A complaint may be submitted in writing/by email and sent to the address sklep@orientana.pl

VIII. FINAL PROVISIONS

8.1. The Seller has the right to change the Regulations at any time, provided that the content of the new Regulations shall apply to orders placed from the date of their posting on the Website.

8.2 In the event of a dispute with the Seller or any doubts as to their rights, the Customer may use out-of-court complaint and claim settlement methods. Using out-of-court complaint and claim settlement methods is voluntary. The principles of conducting proceedings on out-of-court resolution of consumer disputes and the obligations of entrepreneurs in this respect are specified separately in legal regulations (including in particular the Act of 23 September 2016 on out-of-court resolution of consumer disputes, Journal of Laws 2016, item 1823). Detailed information on the possibility of using out-of-court complaint and claim settlement procedures by a Customer who is a consumer, as well as the rules of access to these procedures may be available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection, the Office of Competition and Consumer Protection. The President of the Office of Competition and Consumer Protection keeps a public register of entities authorized to conduct proceedings for out-of-court resolution of consumer disputes.

8.3 The Customer is prohibited from providing content of an illegal nature.

8.4 Any disputes arising between the Seller and the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code or an entity referred to in Article 3855 of the Civil Code shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

8.5. Any disputes arising between the Seller and the Customer who is not a consumer within the meaning of Art. 22[1] of the Civil Code or an entity referred to in Art. 3855 of the Civil Code shall be submitted to the court with jurisdiction over the Seller's registered office.

8.6. In matters not regulated in these Regulations, the provisions of Polish law shall apply.

PROMOTION TERMS AND CONDITIONS "2+1 for 1 PLN"

§1 GENERAL PROVISIONS

  1. The organiser of the promotion "2 + 1 for 1 PLN" (hereinafter: "Promotion") is Orientana Sp. z o. o. with its registered office in Warsaw, ul. Tamka 29/17 00-355 Warsaw, NIP: 9512485034, REGON: 383446443, entered into the register of entrepreneurs of the KRS under number 0001108984 (hereinafter: "Organiser").
  2. The promotion is conducted through the online store available at: https://www.orientana.pl (hereinafter referred to as the "Store").
  3. The promotion runs from June 6 to June 25, 2025 (inclusive) or while stocks of promotional products last.

§2 PROMOTION RULES

  1. The promotion applies only to selected products placed in the “2+1 for 1 PLN” product category in the Store.
  2. Any natural person with full legal capacity who places an order in the Store in accordance with these regulations may participate in the Promotion.
  3. Promotion mechanism:
    a. When adding three products from the “2 + 1 for PLN 1” category to the basket, the customer receives the cheapest of them for PLN 1.
    b. When purchasing a larger number of promotional products (e.g. 6 pieces), the customer receives the two cheapest of them for 1 PLN each.
    c. The promotion applies only to three products – always two full-priced products + one for PLN 1.
  4. The discount is calculated automatically in the shopping cart after meeting the promotion conditions.
  5. The promotion cannot be combined with other discounts
  6. In the event of a return of one of the products covered by the promotion, the price will be refunded in accordance with the proportion applied within the promotion. If a product worth PLN 1 is returned, the customer will receive a refund of PLN 1.

§3 LIMITATIONS AND DISCLAIMERS

  1. The promotion is valid only during its duration and only while stocks of the products covered by the promotion last.
  2. The Organizer reserves the right to change the regulations or end the promotion earlier without giving reasons, provided that the acquired rights of the participants are respected.
  3. Complaints regarding the promotion can be submitted by e-mail to the following address: sklep@orientana.pl . The complaint processing time is 14 days.

§4 FINAL PROVISIONS

  1. Participation in the promotion constitutes acceptance of these regulations.
  2. The regulations are available on the Store's website throughout the duration of the promotion.
